General Terms and Conditions (GTC) and Customer Information

of Trachten Angermaier (Munz Bekleidungs GmbH)

1. scope of application

These General Terms and Conditions (GTC) and customer information apply to all contracts that you conclude with us, Munz Bekleidungs GmbH (Trachten Angermaier), via our online shop at www.trachten-angermaier.de.

2. Delivery / Prices / Shipping costs

We only deliver within the Federal Republic of Germany and to the countries specified in the delivery and shipping costs table. Please refer to the respective item description and the aforementioned table under the link “Delivery information” for delivery times.

All prices are total prices, i.e. they include all price components including statutory sales tax.

In addition to the prices stated, we charge the shipping costs specified in the respective item description or in the delivery and shipping cost table for each order. If the goods are shipped to countries outside the European Union (EU), additional costs such as bank charges, taxes, and/or customs duties may apply depending on the country of delivery, which are to be borne by the customer.

3. Conclusion of contract / Contract language / Correction of input errors

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. You can submit your offer to us by placing the desired items in the virtual shopping cart (click on the “Add to cart” and “Go to cart” buttons) and, after completing the shopping cart process, by submitting the items placed in the shopping cart (click on the “Buy” button). Confirmation of receipt of the order will be sent by email immediately after the order has been submitted and does not constitute acceptance of the offer.

The contract is concluded exclusively in German.

You can correct input errors in the online shop before submitting your order using the technical means provided in the online shop and the usual functions of your keyboard/mouse. You can also cancel the process at any time by closing the browser window. By clicking on the “buy” button, you have placed a binding order (offer); input errors can no longer be corrected after this point.

4. payment

The customer can pay by advance bank transfer, credit card, instant bank transfer, or PayPal.

We kindly ask you to transfer the invoice amount to our bank account within 7 days of receiving the payment request.

  • Credit card (VISA, Mastercard)


    Credit card payments are processed by our payment service provider PAYONE GmbH, Lyoner Straße 9, 60528 Frankfurt/Main, Germany, or WORLDLINE Schweiz AG, Hardturmstrasse 201, CH-8005 Zurich, Switzerland. When selecting this payment method, you enter your payment information securely and in encrypted form. Once the order has been completed, this information will be verified by the Payone Virtual Terminal. Your credit card will be charged once the order has been completed.

  • PayPal

    You pay the invoice amount via the online provider PayPal. You must be registered there or register first. After logging in with your access data, you can confirm the payment instruction to us. PayPal will then process the payment immediately. You will receive further information during the ordering process.



  • IMMEDIATE transfer/KLARNA

You pay directly via your online banking account (PIN/TAN) using the SOFORT AG/KLARNA payment system. After submitting your order, you will be redirected to SOFORT Überweisung/KLARNA, where you can complete the payment.

5. retention of title

The goods remain our property until full payment has been received.

6. Cancellation policy for consumers

According to § 13 BGB (German Civil Code), a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.

If you are a consumer, the following right of withdrawal applies to you:

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.

You can use the attached sample withdrawal form for this purpose, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period expires.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the date on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.

You shall bear the direct costs of returning the goods.

You shall only be liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that is not necessary for testing their condition, properties, and functionality.

 

Exclusion of the right of withdrawal

In accordance with Section 312g (2) No. 1 of the German Civil Code (BGB), the right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

7. contract text storage

We will save the contract text and send it to you by email together with these General Terms and Conditions after you have submitted your order. In addition, you can also view the contract text via our customer login, provided you have created a customer account (user account) before submitting your order.

8. transport damage

If goods are delivered with obvious transport damage, please report such defects to the delivery agent as soon as possible and contact us immediately. Failure to complain about transport damage or to contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you help us to assert our own claims against the carrier or transport insurance company.

10.Applicable law / Place of jurisdiction

The law of the Federal Republic of Germany applies, excluding the provisions of the UN Convention on Contracts for the International Sale of Goods. However, this choice of law applies only insofar as the protection granted by mandatory provisions of the state in which the consumer has his habitual residence is not withdrawn.

If you are a merchant, a legal entity under public law or a special fund under public law (§ 38 ZPO) and you have concluded the contract in this capacity, Munich is agreed as the place of jurisdiction for all disputes arising from this contract. In addition, we reserve the right to sue you at another legal place of jurisdiction.

 

11. Complaints procedure / Dispute resolution

The EU Commission provides a platform for out-of-court dispute resolution. This gives consumers the opportunity to resolve disputes relating to their online orders without first involving a court. We endeavor to settle any disagreements arising from our contract with the customer amicably. Furthermore, we are not obliged to participate in arbitration proceedings and unfortunately cannot offer our customers participation in such proceedings.
